2. Acceptance and scope
By using the website or creating an account in an application you agree to these terms. If you do not agree, do not use the website or applications.
Where you use an application on behalf of a company, you confirm that you are authorised to bind it to these terms.
3. Account and responsibilities
- Provide accurate and current information and keep it up to date.
- Keep your login credentials confidential; you are responsible for activity under your account.
- Notify us without delay at [email protected] if you suspect misuse of your account.
- You are responsible for the correctness of the data and documents you create in the application (e.g. invoice content, tax rates). The application is a tool; it does not replace professional accounting or tax advice.
4. Acceptable use
You must not use the website or applications in a way that is unlawful or harmful. In particular you must not:
- attack, overload, probe or reverse engineer our systems, except as permitted by mandatory law or with our written consent;
- upload or distribute unlawful, infringing, fraudulent or malicious content;
- use the applications to issue fictitious documents or for tax evasion or money laundering;
- circumvent technical restrictions, access other users’ data or resell the service without our consent.
5. Your content and our intellectual property
Data and documents you enter into an application remain yours. You grant us only the rights necessary to store, process and display them in order to provide the service. You can export or delete them at any time.
The software, design, texts, logos and other materials of the website and applications are owned by Platytera, s.r.o. or its licensors. We grant you a non-exclusive, non-transferable, revocable licence to use the applications for their intended purpose for the duration of these terms.
Where we process personal data of your customers on your behalf, we act as your processor under Art. 28 GDPR: we process the data only to provide the service and on your instructions, ensure confidentiality and security, use only bound sub-processors, assist you with data subjects’ requests, and delete the data after the account ends. Details are in the Privacy Policy.
6. Paid features and subscriptions
Basic functions may be free of charge. Paid features or subscriptions purchased in a mobile application are sold and billed through Google Play or the App Store under their terms; the price including VAT is shown before purchase. Subscriptions renew automatically until cancelled in your Google Play or App Store account settings; refunds are handled under the rules of the respective store.
If you are a consumer in the EU, you have the right to withdraw from a contract concluded at a distance within 14 days. By requesting that the digital service is provided immediately, you acknowledge that if you withdraw, you may be asked to pay for the part already provided, and that the right of withdrawal from a contract for digital content ends once delivery has started with your consent.
7. App stores
These terms are concluded between you and Platytera, s.r.o., not with Apple Inc. or Google LLC, which are not responsible for the applications or their content. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you in relation to applications obtained from the App Store. If these terms conflict with the usage rules of the respective store, the store rules prevail to the extent of the conflict.
8. Availability and changes
We strive for reliable operation, but we do not guarantee uninterrupted availability. We may carry out maintenance, update the applications, and change or discontinue features. If we discontinue an application, we will give you reasonable notice and an opportunity to export your data.
9. Warranty and liability
Consumers have the rights arising from defective performance guaranteed by law (including the right to updates of digital content); these rights are not limited by these terms.
Towards entrepreneurs, to the extent permitted by law, the website and applications are provided “as is” and we are not liable for indirect damage, lost profit or loss of data; our total liability is limited to the amount you paid us in the last 12 months. This limitation does not apply to damage caused intentionally or by gross negligence, or to harm to life or health.
10. Termination
You can stop using the applications and delete your account at any time (see Privacy Policy, section 7). We may suspend or terminate an account that is used in serious breach of these terms or the law; where reasonable, we will warn you in advance and allow you to export your data.
11. Single point of contact (Digital Services Act)
Our single point of contact for authorities of EU Member States, the European Commission and recipients of our services under Regulation (EU) 2022/2065 is [email protected]. You can communicate with us in Czech or English. You can also report illegal content there.
12. Governing law and disputes
These terms are governed by the laws of the Czech Republic. If you are a consumer, this does not deprive you of the protection of mandatory provisions of the law of your country of habitual residence.
Consumers may submit a dispute for out-of-court resolution to the Czech Trade Inspection Authority (Česká obchodní inspekce, Štěpánská 567/15, 120 00 Praha 2, adr.coi.cz). Complaints can also be sent to us at [email protected].
13. Changes to the terms
We may change these terms for legitimate reasons (changes in law, services or security). We will notify registered users of material changes at least 30 days in advance; if you disagree, you can delete your account before the change takes effect.
